Introduction

These Terms & Conditions ("Terms") govern your access to and use of the HABITKID web application ("Service"), operated by Y Company, CVR 33693060, registered in Denmark ("we", "us", "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

Alpha Testing Status

The Service is provided as an early alpha version. It is under active development and may contain bugs, errors, and incomplete features. We may at any time change, add, or remove features, reset, modify, or delete data stored in the Service, and suspend or stop the Service temporarily or permanently. You understand and accept that the Service is temporary and experimental, and that stability, availability, and data persistence are not guaranteed.

Eligibility

You must be at least 18 years old and capable of entering into a binding agreement under applicable law to use the Service. By using the Service, you confirm that you meet these requirements.

Accounts and Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use of your account or any security breach. We may suspend or terminate accounts that we reasonably believe are being misused or used in violation of these Terms.

Acceptable Use

You agree that you will not use the Service for any unlawful purpose or in violation of any applicable law or regulation. You will not attempt to gain unauthorized access to the Service or related systems. You will not reverse engineer, decompile, or attempt to extract source code from the Service, except where permitted by mandatory law. You will not upload or share any content that is illegal, harmful, or infringes the rights of third parties.

Changes to the Service and Alpha Program

We may modify or discontinue the Service, in whole or in part, at any time, with or without notice. We may move from alpha to beta or full release at our discretion, and as part of this process we may change the technical architecture, storage, features, pricing, and integrations.

Fees, Subscriptions, and Pricing

During the alpha period, we may offer the Service for free or at experimental or discounted prices. All pricing, plans, and billing terms are subject to change at any time, including when moving from alpha to later versions. Future pricing may differ from any alpha pricing. If we introduce paid plans or change existing fees, we will provide information in the Service or by email before charges apply to you. Your continued use after the effective date of such changes constitutes acceptance of the new pricing.

Data, Storage, and Privacy

Data stored in the alpha version may be deleted, reset, or modified at any time without notice. You are responsible for keeping backups of any information you wish to retain. We process personal data in accordance with our separate Privacy Policy, which explains how we collect, use, store, and protect personal data and your rights under applicable EU and Danish data protection law, including the GDPR. By using the Service, you acknowledge that you have read and understood our Privacy Policy and agree to our processing of your personal data as described there.

Intellectual Property

All intellectual property rights in and to the Service, including software, design, logos, and content we provide, belong to us or our licensors. You receive a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal family use, solely in accordance with these Terms. You retain all rights to content you input into the Service. You grant us a worldwide, non-exclusive, royalty-free license to use such content solely for the purpose of operating, maintaining, and improving the Service.

Feedback

During alpha testing, we may ask for or receive feedback, suggestions, or ideas from you ("Feedback"). You agree that we may use Feedback freely, without restriction and without any obligation to compensate you, for the purpose of improving and developing the Service and related products.

Disclaimers

The Service is provided "as is" and "as available" in its alpha state, without any warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or free of errors, bugs, or data loss.

Limitation of Liability

To the extent permitted by applicable law, we shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of data, profits, or business arising out of or in connection with your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total aggregate liability arising out of or related to the Service or these Terms shall, to the extent permitted by law, be limited to the greater of (a) EUR 50, or (b) the total amount you have paid to us for the Service in the three months preceding the event giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory law, including liability for gross negligence or intentional misconduct where applicable.

Suspension and Termination

We may suspend or terminate your access to the Service at any time, with or without notice, in particular if we suspect misuse or violation of these Terms or if we decide to stop offering the alpha program. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately. We may delete your data in accordance with our data retention practices.

Changes to These Terms

We may update these Terms from time to time, for example to reflect changes in the Service, legal requirements, or business needs. When we make material changes, we will notify you in the Service or by email. The updated Terms take effect from the date stated in the notice. Your continued use of the Service after the updated Terms take effect constitutes acceptance of the changes.

Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or the Service shall be governed by and construed in accordance with the laws of Denmark, without regard to conflict of law rules. Any disputes shall be subject to the exclusive jurisdiction of the courts of Denmark, without prejudice to any mandatory rights you may have as a consumer under applicable EU or local law.
